Enjoy.
We wanted to try this as an experiment, because no one has really done it before for the band. We can do write ups for each city - and those are EXCELLENT, but how about bringing the show to those who can't quite get to it? We're going to attempt that with the people we travel with for this string of shows. Hopefully, you enjoy it, AND CREATE YOUR OWN! If it works out, we should try to encourage people in different cities to do it as well!

Also, people make fanvids on youtube all the time. If the record company gets pissy about it, they'll ask for it to be taken down, but in the meantime, I say carry on.

My understanding is that if the music were playing in the background as you shot footage, and therefore included in the video you posted, you'd be okay. To use the track as it's used here is not. Intent is irrelevant.

Here's how I'd look at it if it were my project: I'm highly risk averse and if I were going to the trouble of doing something awesome like this, I'd want to ensure that it went as smoothly as possible. publishers can request to pull anything with their songs in it, regardless of how, why, or what context. record labels can't pull live recordings, but publishers can. so if the publisher feels like being a d-bag, they'll have your live recording pulled. lately, though, i've been seeing pop ups on videos linking to where you can purchase the song/album on videos using masters in the background. that could be an option if you run into a problem.

I swapped it with a bootleg live recording. If that's a problem again, I'll just pull the whole thing down.
That video is one I took with my digital camera in Minneapolis in November.

1. How long is Brendan's vid.. like 42 seconds long. You are allowed around 30 seconds of a song before copyright and royalties even gets mentioned. (or the 5 songs that have meaning to you meme on YouTube that spread around like wildfire sometime last year would have never occurred... Partners even did this.. and they were allowed 30 second clips... at least) 2. Usually (on YouTube) if you link to the band, a way to purchase the song, etc.. they are not going to ask you to take it down. 3. Most of the time, the only people who have serious problems with the copyrighted music issue are YouTube Partners... they are not allowed to place adds in the videos where they said music playing.

Has anything bad ever happened to anyone for posting a youtube video? Not so far as I know. I do know that various fanvids I've had bookmarked (because, um, I have things like Spike/Buffy fanvids bookmarked, I'm just that cool) have been deleted by youtube because of copyright, but their authors seem to have been left alone. So I don't think it's a big deal. It seems to be quite random how stuff is taken down, too. *shrug* I say put it up, and if it gets deleted, I'm sure we can find a way to host it somewhere that's not youtube.
